I hereby the renter assume all risks of personal injury, death, and property damage from any causes whatsoever arising while participating in golf simulator activities. I or may guests are in good health and physically able to participate in any and all golf-related activities. I agree to unconditionally waive and release Gnomad Golf LLC , and their officers and employees, agents, and all representatives and sponsors from any injury that I or my guests may sustain, or any damage that may be caused to my property in connection with said activities or use of such facilities or services, including injuries sustained or property damage caused by any use of equipment I may rent or borrow from Gnomad Golf, their officers, employees, agents or sponsors, to the extent allowed by law. I understand that the Golf Simulator involves various activities, including swinging clubs and interacting with virtual environments. I hereby acknowledge and agree that the activity of using the Golf Simulator has inherent risks. I have full knowledge of the nature and extent of all the risks associated with using the simulator, including but not limited to: 1. All manner of injury resulting from swinging clubs and interacting with virtual elements; 2. Potential injury from golf balls causing contusions, and other injuries related to golf movements; 3. Risks associated with the use of virtual reality and simulated environments. I further realize that not all risks are listed herein and acknowledge that I am voluntarily and willingly participating in this activity even though some risks are apparent and others are not identifiable. The undersigned, hereafter referred to as the "Renter," acknowledges and agrees that they are solely responsible for the behavior and actions of any guests or participants they invite to use the Gnomad Golf simulator. The Renter accepts liability for any injury, damage, or misconduct caused by their guests during the rental period. The Renter assumes full responsibility for any damage to the Gnomad Golf simulator equipment, including but not limited to, the enclosure, projector, simulator software, and any related accessories. This responsibility extends to damage caused by the Renter, their guests, or any third party during the rental period. In the event of equipment damage, the Renter agrees to cover all repair or replacement costs incurred by Gnomad Golf as a result of such damage. The Renter understands that this includes damage caused by negligence, misuse, or intentional actions.
